1. Acceptance of Terms
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the App.
2. Description of Service
WallFit is an AI-powered wallpaper generation application that allows users to create custom wallpapers using artificial intelligence based on text prompts and preferences.
3. User Accounts
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized use of your account
- You must be at least 13 years old to use the App
4. Acceptable Use
You agree not to use the App to:
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Generate content that infringes on intellectual property rights of others
- Generate content depicting real individuals without their consent
- Generate pornographic, sexually explicit, or adult content
- Generate content promoting violence, terrorism, or hate speech
- Attempt to reverse engineer, decompile, or hack the App
- Use the App to spam or send unsolicited messages
- Interfere with or disrupt the App or servers
5. AI-Generated Content
- All wallpapers generated through the App are created using artificial intelligence
- We do not guarantee that generated content will be free from errors or meet your expectations
- You retain rights to wallpapers you generate for personal use
- We reserve the right to use anonymized generation data to improve our services
- We may refuse to generate or remove content that violates these Terms
6. Subscriptions and Payments
- Some features require a paid subscription
- Subscription fees are billed in advance on a recurring basis
- All payments are processed through Apple App Store or Google Play Store
- Refunds are subject to the policies of the respective app stores
- You can cancel your subscription at any time through your app store settings
- Prices may change with notice; continued use constitutes acceptance
7. Free Tier Limitations
Free users may be subject to:
- Limited number of wallpaper generations per day/month
- Lower resolution output
- Advertisements
- Watermarks on generated images
8. Intellectual Property
- The App, its original content, features, and functionality are owned by Grafpic
- Our trademarks and trade dress may not be used without prior written permission
- You grant us a license to use, display, and distribute content you create for service improvement
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted, timely, secure, or error-free
- Results from the App will be accurate or reliable
- Any errors will be corrected
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAFPIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP.
11. Indemnification
You agree to indemnify and hold harmless Grafpic and its affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
12. Termination
- We may terminate or suspend your account immediately, without notice, for any breach of these Terms
- Upon termination, your right to use the App will cease immediately
- You may terminate your account at any time by deleting the App and contacting us
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Your continued use of the App after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
